Gary B. Gertler is a partner in the law firm of McDermott Will & Emery LLP based in the Los Angeles office. His practice focuses on the representation of hospitals, health systems, multi-specialty and single specialty medical groups, health care companies, practice management companies, and other health care providers with an emphasis on mergers and acquisitions, private equity and debt transactions for startup companies, hospital-affiliated group practices, joint ventures and syndications, health care regulatory and licensure issues, and general health care corporate matters. He works particularly closely with investor-owned and nonprofit health care companies, large multi-specialty and single-specialty physician organizations, large and small surgery center, dialysis center, and imaging center companies and developers, management companies, medical supply vendors, medical equipment lessors, third party payors including HMOs and PPOs and entrepreneurs. Gary’s legal practice also covers the structuring and development of hospital-affiliated physician organizations, including medical foundations, co-management arrangements, ancillary product arrangements, including ancillary services involving outpatient surgery, diagnostic imaging, radiation therapy, rehab services, drugs, DME, and complimentary medicine; and management service organizations, practice management companies, integrated provider networks and related arrangements. Gary belongs to the California State Bar, the United States District Court, Central District of California, and the United States Court of Appeals for the Ninth Circuit. He is also a member of the American Health Lawyers Association and the California Society of Healthcare Attorneys. Gary is a co-author of Navigating Your Way Through the Federal Physician Self-Referral Law, a comprehensive book analyzing the Stark laws, and State Laws and Regulations Governing Preferred Provider Organizations, a study published by the Rand Corporation for the Department of Health and Human Services and the Federal Trade Commission. Knowledgeable but communication could be more consistent

I engaged Gary Gertler and his team at McDermott Will & Emery for assistance with a complex contractual negotiation between our mid-sized clinic and a regional hospital system. With his 39 years of experience and specific recognition in Health Care Law, his deep understanding of the regulatory and operational landscape was immediately apparent. His background, including the MHA from UCLA, provided valuable insight into the business realities of healthcare. The legal strategy he developed was sound and ultimately protected our interests. However, the experience was somewhat mixed. While Gary himself was sharp in meetings, there were periods where communication from his team lagged, with responses taking longer than expected. For a matter that felt urgent to us, the pace sometimes felt procedural. He is clearly a competent and seasoned attorney, as his profile suggests, but managing client expectations on timelines and ensuring consistent touchpoints could be improved. You are getting significant expertise, but the service delivery felt just adequate at this level.
