Tristan Manthey is a partner in Fishman Haygood’s Litigation Section and specializes in bankruptcy. Since 1998, his practice has concentrated on chapter 11 reorganizations, business workouts, debt restructuring, insolvency litigation, and creditor’s rights.Tristan is experienced in complex financial and legal matters involving numerous industries, including but not limited to, oil and gas, medical, construction, manufacturing, hotel and tourism, utilities, gaming companies, public television broadcast companies, service companies, real estate ventures, retailers, and restaurants. With this experience, he has represented debtors-in-possession, creditor committees, secured creditors, significant creditors and investors.As part of the firm’s bankruptcy team, Tristan has had significant experience successfully representing creditors’ committees in Louisiana, Texas, and Mississippi, including Venture, Inc., Energy XXI, Louisiana Heart Hospital, Acadiana Management Group, Petroquest Energy and Seahawk Drilling, and debtors, like Knight Energy Holdings and Harvest Oil & Gas, in major bankruptcy cases. The team has been a key participant in bankruptcy cases and workouts across the country.Most recently, Fishman Haygood’s bankruptcy team was chosen to represent the plant-based food company Atlantic Natural Foods, which owns and distributes vegan brands Loma Linda, Chik’n, Tuno, Neat, Kaffree Roma, and Modern Menu nationwide, in its chapter 11 bankruptcy case. The case is pending before the Hon. Meredith S. Grabill in the United States Bankruptcy Court for the Eastern District of Louisiana (New Orleans).Significantly, Tristan provided bankruptcy counsel to the law firm Clark, Love & Hutson (“CLH”), which is a member of the Plaintiff Steering Committee representing approximately 15,000 claimants in the pending multidistrict 3M Combat Arms Earplug Products liability litigation (the largest MDL ever) at the center of the bankruptcy cases filed by Aearo Technologies LLC and six affiliated debtors in July 2022. On August 26, 2022, after a days-long trial, the Hon. Jeffrey Graham of the United States Bankruptcy Court for the Southern District of Indiana (Indianapolis Division) ruled in favor of CLH’s clients and similarly situated military veterans with hearing loss claims related to 3M earplugs. This was a landmark ruling that allowed the claimants to continue the multidistrict litigation against 3M, a significant victory for the claimants. As a result, 3M agreed to a $6 billion out-of-court settlement in August 2023.Tristan formerly served as chairman of the Bankruptcy Section for the Louisiana State Bar Association (LSBA), a board member of the Bankruptcy Section for the Federal Bar Association, and a member of the House of Delegates for the LSBA.
