Grabill in the United States Bankruptcy Court for the Eastern District of Louisiana (New Orleans).Significantly, Tristan provided bankruptcy counsel to the law firm Clark, Love & Hutson (“CLH”), which is a member of the Plaintiff Steering Committee representing approximately 15,000 claimants in the pending multidistrict 3M Combat Arms Earplug Products liability litigation (the largest MDL ever) at the center of the bankruptcy cases filed by Aearo Technologies LLC and six affiliated debtors in July 2022. On August 26, 2022, after a days-long trial, the Hon. Jeffrey Graham of the United States Bankruptcy Court for the Southern District of Indiana (Indianapolis Division) ruled in favor of CLH’s clients and similarly situated military veterans with hearing loss claims related to 3M earplugs.
This was a landmark ruling that allowed the claimants to continue the multidistrict litigation against 3M, a significant victory for the claimants. As a result, 3M agreed to a $6 billion out-of-court settlement in August 2023.Tristan formerly served as chairman of the Bankruptcy Section for the Louisiana State Bar Association (LSBA), a board member of the Bankruptcy Section for the Federal Bar Association, and a member of the House of Delegates for the LSBA.
