Parker Griffin regularly represents creditors in both bankruptcy cases and out-of-court workouts and debt restructurings, much of which involve real estate and other forms of asset-based lending. Parker currently serves as the chair of the Creditors’ Rights Subcommittee for the American Bar Association, and previously served as the co-vice chair of the subcommittee from 2014 to 2017.In his representation of creditors, Parker is routinely involved in insolvency and bankruptcy-related litigation in both state and federal court, including preference and fraudulent transfer actions, stay relief actions, non-dischargeability actions, mortgage-related litigation, and various state law creditor remedies, such as foreclosures, executions, garnishments, charging orders, and rent interception. He has also successfully represented lenders in both state and federal courts in obtaining the appointment of receivers over distressed commercial and multi-family properties, and he also has experience representing receivers in matters where he is not representing the lenders.Parker has extensive experience in corporate bankruptcies under Chapter 11 of the Bankruptcy Code, which includes litigating issues related to the use of cash collateral, section 363 sales of property outside the ordinary course of business, claims allowance and disallowance, avoidance actions, and confirmation of liquidating plans and plans of reorganization.Additionally, he represents commercial landlords in a broad range of matters, including lease negotiations, unlawful detainer proceedings, ADA compliance, rent collections and tenant bankruptcies.
