Russ Morgan is a trial lawyer in the firm’s Litigation Section. He represents and advises clients in health care, product liability and construction litigation. He has been recognized in several publications, including The Best Lawyers in America (Commercial Litigation and Construction); Chambers USA: America’s Leading Lawyers for Business; Nashville Business Journal’s “Best of the Bar”; and Super Lawyers.Healthcare Russ represents health care providers undergoing government investigations, including those conducted by the Department of Health and Human Services, the Tennessee Bureau of Investigation and other governmental agencies. In addition, he has extensive experience in all aspects of litigation that affect healthcare clients, including healthcare technology, whistleblower/qui tam, EHR, HIPAA/HITECH, payor disputes, anti-kickback violations, overpayment claims by Medicare/Tenncare, corporate disputes, misappropriation of trade secrets and unfair competition. Russ served on the governing board of a federally qualified health clinic for serving underserved patients for six years (two years as vice chair), which provided him valuable insight into the needs and practices of health care clients. Russ is a member of the American Health Lawyers Association.Product Liability Russ has extensive experience representing and advising clients on major product liability issues, including recalls, retrofits and supplier disputes. Recently, he guided a client through a recall mandated by the U.S. Consumer Product Safety Commission. He counseled another client through a bet-the-company retrofit and on its internal investigation as to cause and origin. Russ represents product manufacturer clients in product liability and supplier litigation, including pharmaceutical companies in litigation pending in Tennessee and Kentucky. He formerly served as in-house Litigation Attorney with Caterpillar Inc., advising the company on product liability and supplier issues, including indemnification claims. He is a member of the Federation of Defense and Corporate Counsel and the Defense Research Institute.Construction Russ represents owners, general contractors and subcontractors in construction litigation. He is Tennessee counsel for Pulte Group, one of the country’s largest homebuilders and also has significant experience representing health care companies in litigation relating to their healthcare facilities. Russ is active in The Associated of General Contractors of America, Middle Tennessee Chapter.In addition to these areas of focus, Russ has handled a variety of litigation for corporate clients, including intellectual property (patent, trademark and copyright), trade secret, non-competition, partnership and closely-held corporate disputes, oil and gas disputes, fraud, misappropriation and securities fraud. Russ is licensed in Tennessee and Kentucky and regularly practices in both states.Russ frequently speaks on issues of concern for corporate counsel, such as crisis management, internal investigations and attorney-client privilege. He also speaks on product liability matters. Russ serves on the Boards of the Make-A-Wish Foundation and Junior Achievement.On a personal level, Russ is active in his church and enjoys spending time with his wife, Melanie, and newborn baby, Eliza.
