Our company retained Mark Pearlstein after receiving a formal inquiry from the SEC regarding certain financial disclosures. His reputation in white-collar defense and his specific recognition in this area were primary factors in our selection. There is no question about his deep substantive knowledge; his 40+ years of experience, particularly with the SEC, was evident in his strategic assessment of our situation. He successfully navigated the inquiry to a resolution without enforcement action, which was the ultimate goal. However, the experience felt somewhat transactional. Communication was occasionally slow, with responses sometimes taking several days, which increased our anxiety during a stressful period. While his senior associates were sharp, we had expected more direct, consistent engagement from Mr. Pearlstein himself given his profile. The legal outcome was positive, but the client service aspect felt merely adequate. For bet-the-company litigation, his expertise is likely indispensable, but for our matter, the process could have been more collaborative.
