Litigation partner Kate Campbell handles environmental, toxic tort and class action litigation and Superfund and RCRA remediation matters*. Since joining the firm in 2003, she has developed considerable experience in defending complex toxic tort claims for personal injury, wrongful death, medical monitoring and property damage, in representing potentially responsible parties across the country in CERCLA and RCRA matters, and in litigating federal, state and private enforcement actions under an array of environmental statutes. In addition to her litigation and remediation practice, Kate has also been involved for many years in activities involving Total Maximum Daily Loads (TMDLs) for toxic pollutants, advocating on behalf of individual clients and a regional coalition of industrial and municipal dischargers. Through this work, she has been able to develop a detailed understanding of the nuances of the Clean Water Act and the TMDL regulatory program, and the contours of TMDL litigation at the federal and state levels. Competent on complex environmental litigation, but communication was inconsistent

Kate Campbell handled a complex environmental compliance issue for our manufacturing company, stemming from a legacy Superfund site. Her deep knowledge of RCRA and her 20+ years of experience in environmental litigation were evident. She is clearly a recognized expert in this niche, and her analysis of our potential liability was thorough. However, our experience was mixed. While the legal strategy was sound, there were periods where communication lagged, making it difficult to get timely updates on procedural steps. Responses to emails sometimes took several days. The outcome was ultimately satisfactory, but the process required more proactive management on our part than expected. For straightforward matters requiring her specific expertise, she is capable, but be prepared to follow up diligently.
