Herbert E. Tucker, IV, was born in Lake Forest, Illinois. He graduated from the University of Colorado (B.S. 1979) and Mississippi College (J.D. 1985). He is admitted to the U.S. Supreme Court; U.S. District Court, District of Colorado; U.S. Court of Appeals,Tenth Circuit; and Colorado State Courts. Mr. Tucker served as a Law Clerk to Judge Field C. Benton, Denver Probate Court (1985-1986).Mr. Tucker is a Fellow in the American College of Trust and Estate Counsel (ACTEC). He is a member of the Trust & Estate Section of the Colorado Bar Association and serves as Chair of the Probate Trial and Procedure Subcommittee, Chair of the Colorado Dead Man Statute Subcommittee, and as a member of the Statutory Revisions Committee, the Colorado Uniform Trust Code Subcommittee, and the Continuing Legal Education Subcommittee. He is also a member of the El Paso County, Colorado and American Bar Associations.His articles have been published in The Colorado Lawyer, Trust & Estate Section Council Notes of the Colorado Bar Association, and Trial Talk of the Colorado Trial Lawyers Association. Mr. Tucker has lectured at local and national Continuing Legal Education programs, the NAELA Institute, and the third Biennial Conference Advanced Elder Law Institute, University of Denver. Mr. Tucker's practice focuses on the areas of estate and trust litigation, estate and trust administration and as expert witness regarding fees and fiduciary compliance.Mr. Tucker has an AV rating with Martindale-Hubbell, and is also listed in Best Lawyers in America, Colorado Super Lawyers and is a Fellow of the Colorado Bar Foundation. Adequate estate litigation help, but communication was inconsistent

I hired Mr. Tucker to handle a contested probate matter involving my late uncle's trust. With his 40 years of experience and the recognition he's received in trusts and estates litigation, I felt confident in his technical ability. His deep knowledge of Colorado probate law was evident, and he successfully navigated the court proceedings to a settlement. However, the experience was mixed. While his analysis was sharp, his communication style was often difficult to manage. There were significant delays in receiving responses to emails, and updates on case developments were sometimes provided only after I initiated contact. His billing was precise, but the overall process felt less collaborative than I had hoped. For straightforward, high-stakes litigation, his expertise from Evans Case LLP is undeniable. Yet, for clients who prioritize consistent, proactive communication and a more hands-on feeling from their attorney, expectations may need to be managed. He is a competent and seasoned lawyer, but the client service aspect felt merely adequate.
