Bio

Gerry Fagan has been practicing as a civil litigator at one of the top Montana law firms since 1998. Gerry is a Montana native who graduated with Honors from the University of Montana School of Law. He has tried over ten jury trial cases throughout Montana, including in Billings, Missoula, and in Great Falls, Montana. He primarily handles the defense of claims for personal injury, product liability, malpractice, employment, and municipal liability. He also handles a wide range of commercial litigation claims, as well as some insurance coverage issues. He has successfully defended manufacturers of such products as cars, motorcycles, and trenching machines; oral surgeons on a state wide basis; employers against wrongful discharge suits; and many cities and towns in Montana against all manner of municipal liability claims, including claims alleging wrongful death by law enforcement officers. Gerry has also successfully handled insurance coverage declaratory judgment actions, obtaining in one matter an Order reimbursing an insurer over $350,000 in defense fees expended. He also handles larger construction disputes and represents several of the largest contractors in the Billings area. Gerry's overall litigation philosophy is to be aggressive, but in a smart and pragmatic way.
