Bio

Dan Deane is co-leader of the TCPA team and deputy leader of the Class Actions and Aggregate Litigation group. His practice focuses on defending businesses and individuals in high exposure complex civil and criminal litigation in state and federal court and before regulatory agencies. Dan’s clients include national and international businesses and individuals in a variety of industries with a focus in health care, insurance, and financial services. What do you focus on? My practice focuses in four main areas.Class Action and aggregate litigation defenseI work with several financial service providers, including some of the nation’s largest national banks. I have secured favorable results for clients by defeating class certification and enforcing contractual arbitration and class-waiver provisions. I have particular experience defending lenders and other consumer-facing businesses against claims relating to debt collection practices, including claims under the Telephone Consumer Protection Act (TCPA), Fair Debt Collection Practices Act (FDCPA), Fair Credit Reporting Act (FCRA), and state consumer protection laws.Government Investigations and Criminal DefenseI help individuals and companies navigate through federal and state criminal investigation. I’m currently representing a high-level executive under investigation for violation of federal anti-fraud laws and a business facing civil and criminal investigation for violation of environmental protection laws.Employer DefenseI also represent employers defending claims of discrimination, wrongful discharge, and wage-and-hour class action litigation. I have successfully enforced non-competition and arbitration agreements.AppealsBecause of my track record of success and my insider’s perspective as a former law clerk to a federal appellate judge, I am a recognized “go-to” resource within the firm when cases are appealed. I have briefed and argued before the First, Fourth, Ninth, and Tenth United States Courts of Appeal, as well as the New Hampshire and United States Supreme Courts. Expert guidance through a complex commercial litigation

Dan Deane provided exceptional counsel during a challenging commercial dispute for my company. His deep experience, particularly his recognized expertise in complex civil litigation and class action defense, was immediately evident. He masterfully navigated the arbitration process, and his leadership role at Nixon Peabody in the TCPA and aggregate litigation groups gave us immense confidence. While his strategic insight was invaluable, communication timing could occasionally be a bit slower than expected during non-critical phases. Overall, his 23 years of practice and sharp analytical skills delivered an excellent outcome. Highly recommended for high-stakes business defense.
